Marie's Catering LTD trading as Marie's Emporium Subscription Cancellation Policy
This Subscription Cancellation Policy (the "Policy") applies to all subscription box services (the "Services") provided by Marie's Emporium ("Company," "we," "our," or "us"). By subscribing to our Services, you agree to the terms set forth in this Policy and to your statutory rights under applicable UK law.
1) Statutory Cooling-Off Rights
Under the Consumer Contracts Regulations and the Digital Markets, Competition and Consumers Act 2024, you are entitled to cancel your subscription without penalty within fourteen (14) days of entering into the contract. If your subscription involves delivery of goods, the 14-day cooling-off period begins the day after you receive your first box. To exercise this right, you must notify us by email at Emporium@mariesmail.co.uk or through our online cancellation form within the 14-day period. If you cancel during this time, you may be entitled to a refund, subject to deductions for any goods or services already provided.
2) Pre-Contract Information
Before subscribing, we will provide clear information regarding the cost of your subscription, billing frequency, renewal terms, cancellation rights, and how to cancel. By proceeding with your subscription, you acknowledge receipt of this information.
3) Renewal Notices
We will provide you with a reminder notice before any renewal of your subscription, particularly where the subscription auto-renews or where an initial free or discounted period comes to an end.
4) Notice of Cancellation (Outside Cooling-Off Period)
Subscribers may cancel their subscription at any time after the statutory cooling-off period; however, a minimum of thirty (30) days’ advance written notice is required. Notice of cancellation must be submitted in writing to Marie's Emporium via email at Emporium@mariesmail.co.uk or through our online cancellation form. Cancellation methods will not include unnecessary steps, and you must be able to cancel using a method as easy as the way you subscribed (e.g., if you subscribed online, you can cancel online).
5) Effective Date of Cancellation
Contractual cancellations outside the statutory cooling-off period become effective thirty (30) days after the Company’s receipt of the written cancellation notice. Any subscription charges scheduled within this 30-day notice period shall remain due and payable.
6) Subscription Benefits During Notice Period
Subscribers will continue to receive subscription boxes and benefits associated with their plan during the thirty (30) day notice period.
7) Refunds
If you cancel under your statutory cooling-off rights, we will process refunds in accordance with applicable UK law, normally within 14 days of receiving your cancellation request (and, where goods are supplied, once returned if required). Refunds will be issued using the same payment method used for the original transaction, unless you expressly agree otherwise.
8) Refunds may be subject to deductions for goods or services already supplied.
Outside statutory cooling-off rights, the Company does not provide refunds, credits, or prorated adjustments for partial subscription periods. All fees paid and payable during the notice period are non-refundable.
7) No Penalties
We will not impose penalties or charges for cancellations made under statutory cooling-off rights.
8) Company Rights
The Company reserves the right to update, amend, or modify this Policy at any time. Any such changes will be effective upon posting to our website. Such changes will not affect your statutory rights.
8) Governing Law
This Policy shall be governed by and construed in accordance with the laws of England and Wales.
